The steps of a no-fault divorce
You can apply for a divorce together or by yourself depending on your personal circumstances. This is easier than before as there is no need to set out the reasons for the breakdown of the relationship. If you apply for the divorce by yourself then your spouse will be sent a copy of the divorce petition and given 14 days to complete and return the petition to the court. After this you will be given a 20 week reflection period. During this time you can decide whether or not you are happy with the decision that you have made. Perhaps you may try living separately or talking through your issues to ensure that a divorce is the right choice for you. At the end of the 20 week reflection period you can apply for a conditional order. This can be done together or separately again depending on your personal circumstances. Once the conditional order is granted there is a further 6 week and 1 day wait after which you can apply for the final order. Once you receive the final order the divorce is complete.
